| An
MTS Advanced Inc. statement of account is deemed to be correct
and binding on a customer if a written objection is not
received by MTS Advanced Inc. within thirty (30) days after
the statement of account is rendered. If you have chosen
to receive an email statement, you are responsible for reading
your statement. A customer's failure to receive or read
a statement of account specifying the amount owing by the
customer does not relieve the customer from liability for
payment of such amounts to MTS Advanced Inc. when due.
MTS Advanced Inc. has the right to charge a financing fee
on all invoices and charges that remain unpaid after the
due date specified in the statement of account.
MTS Advanced Inc. reserves the right to charge a fee for
any manner of payment that was returned due to non sufficient
funds.
Where a customer fails to pay a statement of account, including
any applicable taxes specified in the statement of account,
by the payment due date, MTS Advanced Inc. may terminate
the service in accordance with the Sympatico Service Agreement.
We will institute collection proceedings, which may include
the commencement of a legal action to collect the full amount
due plus interest and all legal costs. Where service is
reconnected, a reconnection charge will apply.
If your accounts goes into arrears, MTS Advanced Inc. reserves
the right to limit your method of payment to only pre-authorized
debit.
Service Disconnection
Service may be disconnected, at any time without notice,
for the following reasons:
•the operations or efficiency of the Service is impaired
by the use of the Account
•any amount is past due
there has been or is any breach of any term of condition
of the Service Agreement
• a customer used the MTS Advanced Inc. network for
unlawful purposes
• a customer attempts to defraud MTS Advanced Inc.
Any termination of this Agreement shall not relieve you
from any amounts owing or other liability accruing hereunder
prior to the time that such termination becomes effective.
